For weeks, Daniel Penny has sat quietly in the courtroom as prosecutors and defense attorneys have questioned other passengers who were on the subway that day, along with police, medical experts and several of Penny’s loved ones. On Friday afternoon, Penny’s attorneys rested their case without putting their client on the witness stand.

Sanchez’s 911 call was one of several that prosecutors aired during their case against Daniel Penny, the former Marine who put homeless street artist Jordan Neely in a fatal chokehold on a New York City subway in May 2023. Later, Sanchez took cell phone video of first responders treating Neely, who appeared limp and non-responsive.

Jordan Neely was killed aboard an NYC subway train in May 2023 by a white marine who calls himself trying to play hero. BOSSIP reported extensively on the incident in which that white man, Daniel Penny, applied a chokehold for so long that Neely eventually stopped breathing and died in front of a train car of commuters.
